From the likely perspective of the average American citizen, the term “illegal immigrant” refers to Mexicans or potential terrorists. Yet, the truth is an entirely different story.

Of the more than 11.3 million undocumented aliens currently in the U.S., an estimated 12,000 are ethnic Hungarians, according to the Hungarian Free Press. It is important to understand that, although Amnesty International has cited Hungary as “the most disappointing European country” in terms of human rights,

In the last five years, over 825,000 ethnic Hungarians received Hungarian passports as part of the Orbán government’s 2010 fast-tracked dual-citizenship law. Over 95% of the new citizens are from … Serbia, Ukraine, and Romania (which) are not participants in the U.S. Visa Waiver program. Entry to the U.S. from these countries is hard, if not impossible.”

Hard, if not impossible – except if those Serbs, Ukrainians, and Romanians have dual-citizenship in Hungary. They are able to travel on a Hungarian passport and, thus, enter the U.S. under the U.S. Visa Waiver system.

In 2014, 2,696 visitors to the U.S. on Hungarian passports overstayed and 2,320 simply disappeared.

In 2015, another 2,216 overstayed and 1,860 disappeared.

It is not irresponsible to assume that during the last six years of the Visa Waiver program about 2,000 Hungarians become illegals in the US every year.”

With the current U.S. administration beginning its promised crackdown on illegal immigrants, it is likely that some carrying Hungarian passports will be caught in the web of the DHS. For the law-abiding segment of those, there is a reason for concern. They will not likely desire to be deported to a country with a miserable human rights record and, although they may be Serbian, Ukrainian, or Romanian, they entered the U.S. with a Hungarian passport. Hungary is the country to which they would be deported.

There is, however, a form of relief and American Corporate Services, Inc. Law Office can help. Undocumented Hungarians may apply for asylum status in the U.S. and legally stay in the in the country during the 5-7 years long process of their petition review. Also, they will be able to obtain Work Authorization and will work legally in the USA.
