In addition to the December 9th deadline for Congress to determine whether the EB-5 Regional Center program will continue, the USCIS will be increasing filing fees for EB-5 and other visa type applications and petitions on December 23, 2016.

No one likes to see price increases for anything or for any reason. However, the USCIS has held fees constant for six years, although it reviews them every two years. On average, fees will increase by 21 percent. Following is a brief list of fee changes that will go into effect on December 23rd.

Form Name Current Fee New Fee
I-526 Immigration Petition by Alien Entrepreneur $1,500 $3,675
I-485 Application to Adjust Status $985 $1,140
I-765 Application for Employment Authorization $380 $410
I-90 Application to Replace Green Card $365 $455
N-400 Application for Naturalization $595 $640

The new regulation further clarifies that persons filing any benefit request may be required to appear for biometrics services or an interview and may be required to pay the associated biometrics services fee
