Why U.S. Immigration Law Is Important for Foreign Nationals

Immigration law is important. In fact, it is significantly important in the United States because of the U.S. Constitution.

 

The preamble to the U.S. Constitution identifies ensuring domestic tranquility as one of the document’s reasons for being the foundation for all the laws of the country.

 

The word “tranquility” is no longer commonly used in American English. It simply means, “free from commotion or tumult; peaceful; quiet; calm.” Domestic tranquility, therefore, means being able to live in the U.S. “free from commotion or tumult, peacefully and quietly, without worrying about harm. The concept of domestic tranquility is based on a foundational truth originally included in the Declaration of Independence – that all men have been endowed with an inalienable right to life, liberty, and the pursuit of happiness. The Constitution does not grant that right. It is granted by the Creator. The Constitution was written to define the federal government’s responsibility to protect that right for the people of the United States.

 

Immigration law is essential to maintaining domestic tranquility. Laws define the limits of activities by citizens, businesses, institutions, agencies, and governments. Those limits are intended to keep us safe. Controlling speed limits on the nation’s highways helps to keep travelers safe. Exceeding those limits endangers others who have the inalienable right to life.

 

Governing with the goal of protecting the tranquility of the citizenry necessitates imposing regulations and limitations. From an immigration perspective that may mean different kinds of regulations and limitations based on the type of immigration being sought.

 

Regardless of why any foreign national desires to move to the United States, one thing that he or she should expect is to enjoy the same domestic tranquility that his neighbors do. Whether an investor, a student, an employee, or a refugee, each should have the same expectation. And, so should all of the current legal residents.

 

Any influx of immigrants has an economic impact, whether positive or negative. The purpose of immigration law is, among other reasons, to control the number and flow of immigrants of all types so that their welcomed entrance into the U.S. will contribute to the domestic tranquility more than disrupt it.

 

On the other hand, why would a student want to go to school in a strife-torn country? Why would an investor want to move his business to an unstable environment? Why would a refugee want to flee to a country where they would live with the same fears they were trying to escape?

 

People immigrate to other countries for better opportunities. One of the most coveted opportunities offered by the United States of America is the protection of the inalienable rights of life, liberty and the pursuit of happiness: Domestic Tranquility.
