Perhaps the recent memory of a potential U.S. government shutdown in December 2015 was lingering in the mind of Congressman Tom Marino (R-PA) during a February Judiciary Committee meeting on the future of the EB-5 program.

Perhaps he was remembering the threat that “tens of thousands of non-essential government employees will be laid off” if an omnibus spending bill (which included the continuation of the EB-5 investment visa program) were not passed.

Perhaps, when he considered the failure of the USCIS to keep up with the increased demand for EB-5 visas, he asked himself, “Why does the government employ non-essential workers?” or “How many non-essential workers are employed at the USCIS.

Perhaps it was the report from the Government Accountability Office that said that the USCIS “is failing to track information about investors,” including simple details like names and birthdates.

Perhaps it is all of the above that motivated him to reprimand Nicholas Colucci, Chief of the USCIS’ Immigration Investor Program, telling him the USCIS “better get off their cans and fire somebody.”

Regardless of what may or may not have prompted Marino, his declaration cuts through the fat of politics and bureaucracy right to the heart of the matter. In the real world outside of the halls of government, the people responsible for getting the job done would have been fired long ago and replaced with others who have the initiative and determination to make the process more efficient and to get the job done.

Perhaps Mr. Colucci will act on Mr. Marino’s advice. Perhaps he won’t. Then again, perhaps Donald Trump might be our next president and we will hear him say his favorite two words to Mr. Colucci: “You’re fired!”
